Subject to the terms of clause 11 of the DPA, CloudM will Process Personal Data for the duration of the Main Agreement, unless otherwise agreed in writing.
Clause 11.2: On termination of the Main Agreement for any reason or expiry of its term, CloudM will securely destroy or, if directed in writing by the End User, return and not retain, the Personal Data related to this DPA in its possession or control, save that CloudM may retain the Personal Data where it has a legitimate reason for doing so and for no longer than the maximum retention period applicable to such Personal Data, as set out in the Privacy and Data Protection Requirements. For the avoidance of doubt, CloudM will retain Personal Data that is relevant to the provisions of the Main Agreement that survive termination for as long as those provisions survive, as well as Personal Data that is necessary to enforce its legal rights.
